In Hong Kong, information access has been increasingly restricted, particularly following the enactment of the Hong Kong National Security Law (HKNSL) in 2020 and the Safeguarding National Security Ordinance (SNSO) in 2024. These measures have significantly curtailed press freedom, civil society oversight, and public access to government data, diverging from international human rights standards.<\/p>\n\n\n\n<p>The increasing criminalisation of information access in Hong Kong has led to weakened transparency, press suppression, and reduced corporate data availability. The impact extends beyond journalists to businesses, researchers, and international organizations. Legal reforms, stronger civil society engagement, and international accountability measures are necessary to restore freedom of information and Hong Kong\u2019s reputation as a global financial and information hub.<\/p>\n\n\n\n<p>Against this background, this report explores the current state of information freedom in Hong Kong, the challenges faced, and the path forward in ensuring an open and informed society. Key findings and remedies are provided as follows:<\/p>\n\n\n\n<p><strong>Key Findings<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legal and institutional barriers:<\/strong> Hong Kong lacks both an Archive Law and a Freedom of Information Law, leading to government opacity and arbitrary record destruction.<\/li>\n\n\n\n<li><strong>Press freedom erosion:<\/strong> Journalists face censorship, visa denials, harassment, and arrests, resulting in self-censorship and media retreat from Hong Kong.<\/li>\n\n\n\n<li><strong>State control over information supply chain:<\/strong> The government has increased public data removal, rejected information requests, and imposed court injunctions to suppress access to critical information.<\/li>\n\n\n\n<li><strong>Legal repercussions for information access:<\/strong> Ambiguous definitions of \u201cstate secrets\u201d and \u201cespionage\u201d in the SNSO expose researchers, businesses, and journalists to potential prosecution.<\/li>\n\n\n\n<li><strong>International business and investment risks:<\/strong> Restrictions on financial data transparency and extraterritorial application of security laws undermine Hong Kong\u2019s attractiveness as an international business hub.<\/li>\n<\/ul>\n\n\n\n<p><strong>Remedies<\/strong><\/p>\n\n\n\n<p><strong>For the Legal System:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Enact Archive Law and Freedom of Information Law in compliance with ICCPR and international best practices.<\/li>\n\n\n\n<li>Reverse court decisions that restrict free access to information, including the ban on the protest song <em>Glory to Hong Kong<\/em>.<\/li>\n<\/ul>\n\n\n\n<p><strong>For the Executive Government:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cease enforcing censorship policies, information removals, and national security laws that restrict information access.<\/li>\n\n\n\n<li>Implement UN recommendations to repeal or amend the HKNSL and SNSO to align with international human rights obligations.<\/li>\n\n\n\n<li>Protect journalists, researchers, and civil society members from harassment and legal intimidation.<\/li>\n\n\n\n<li>Improve existing legal and regulatory frameworks in light of latest UN standards and principles on access to information<\/li>\n<\/ul>\n\n\n\n<p><strong>For Business Corporations, Chambers &amp; Investors:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Advocate for clear definitions of state secrets to ensure market transparency.<\/li>\n\n\n\n<li>Strengthen corporate policies against compliance with excessive government data requests.<\/li>\n\n\n\n<li>Maintain transparency reports on information requests from the Hong Kong authorities.<\/li>\n<\/ul>\n\n\n\n<p><strong>For Civil Society:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Strengthen networks of support for Hong-Kong-based journalists and researchers.<\/li>\n\n\n\n<li>Utilize censorship-resistant technologies (e.g., blockchain, IPFS) to safeguard public data and digital archives.<\/li>\n\n\n\n<li>Provide adequate resources and trainings to groups that sustain and contribute to the information supply chain in Hong Kong<\/li>\n<\/ul>\n\n\n\n<p><strong>For International Organizations:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>UN agencies and human rights bodies should monitor and report on the state of information access in Hong Kong.<\/li>\n\n\n\n<li>Strengthen international diplomatic pressure on China and Hong Kong to uphold information integrity and human rights.<\/li>\n<\/ul>\n\n\n\n<p><strong>\u97cc\u6027\u5275\u65b0\u5be6\u9a57\u5ba4\uff08Resilience Innovation Lab, RIL\uff09<\/strong>\u5f88\u9ad8\u8208\u6b63\u5f0f\u767c\u4f48\u7814\u7a76\u5831\u544a\uff0c\u6a19\u984c\u70ba\u300a\u7dad\u8b77\u9999\u6e2f\u8cc7\u8a0a\u81ea\u7531\uff1a\u6311\u6230\u3001\u6a5f\u6703\u8207\u51fa\u8def\u300b\u3002\u4e2d\u6587\u7248\u53ca\u82f1\u6587\u7248\u7684\u5b8c\u6574\u5831\u544a\u73fe\u5df2\u4e0a\u7dda\uff1a<\/p>\n\n\n\n<p>\u5831\u544a\u5168\u6587\uff08\u4e2d\u6587\u7248\uff09\uff1a\u6309\u6b64<a href=\"https:\/\/resilienceinnovationlab.org\/wp-content\/uploads\/2025\/04\/RIL_CHI_Safeguarding-Freedom-of-Information-in-Hong-Kong.pdf\" data-type=\"link\" data-id=\"https:\/\/resilienceinnovationlab.org\/wp-content\/uploads\/2025\/04\/RIL_CHI_Safeguarding-Freedom-of-Information-in-Hong-Kong.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u4e0b\u8f09<\/a><\/p>\n\n\n\n<p>\u5831\u544a\u5168\u6587\uff08\u82f1\u6587\u7248\uff09\uff1a\u6309\u6b64<a href=\"https:\/\/resilienceinnovationlab.org\/wp-content\/uploads\/2025\/04\/Safeguarding-Freedom-of-Information-in-Hong-Kong.pdf\" data-type=\"link\" data-id=\"https:\/\/resilienceinnovationlab.org\/wp-content\/uploads\/2025\/04\/Safeguarding-Freedom-of-Information-in-Hong-Kong.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u4e0b\u8f09<\/a><\/p>\n\n\n\n<p>\u8cc7\u8a0a\u81ea\u7531\u4e43\u6c11\u4e3b\u8207\u826f\u6cbb\u4e4b\u57fa\u77f3\uff0c\u4fc3\u9032\u900f\u660e\u5ea6\u3001\u554f\u8cac\u53ca\u516c\u773e\u4fe1\u4efb\u3002\u81ea2020\u5e74\u300a\u6e2f\u5340\u570b\u5b89\u6cd5\u300b\uff08HKNSL\uff09\u53ca2024\u5e74\u300a\u7dad\u8b77\u570b\u5bb6\u5b89\u5168\u689d\u4f8b\u300b\uff08SNSO\uff09\u5be6\u65bd\u4ee5\u4f86\uff0c\u9999\u6e2f\u7684\u8cc7\u8a0a\u5b58\u53d6\u7a7a\u9593\u660e\u986f\u53d7\u9650\u3002\u9019\u4e9b\u63aa\u65bd\u56b4\u91cd\u9650\u5236\u4e86\u9999\u6e2f\u7684\u65b0\u805e\u81ea\u7531\u548c\u516c\u6c11\u793e\u6703\u76e3\u7763\u653f\u5e9c\u7684\u529f\u80fd\uff0c\u9f13\u52f5\u653f\u5e9c\u96b1\u6c92\u672c\u53ef\u958b\u6e90\u7684\u516c\u5171\u6578\u64da\uff0c\u504f\u96e2\u570b\u969b\u4eba\u6b0a\u6a19\u6e96\u3002\u8cc7\u8a0a\u5b58\u53d6\u548c\u50b3\u64ad\u65e5\u76ca\u5211\u4e8b\u5316\uff0c\u5c0e\u81f4\u653f\u5e9c\u900f\u660e\u5ea6\u4e0b\u964d\u3001\u5a92\u9ad4\u88ab\u58d3\u5236\u53ca\u964d\u4f4e\u4f01\u696d\u6578\u64da\u53ef\u7372\u6027\uff0c\u5f71\u97ff\u6ce2\u53ca\u8a18\u8005\u3001\u5546\u754c\u3001\u7814\u7a76\u4eba\u54e1\u53ca\u570b\u969b\u7d44\u7e54\u3002<\/p>\n\n\n\n<p>\u9999\u6e2f\u8cc7\u8a0a\u81ea\u7531\u7684\u9000\u6b65\u53cd\u6620\u900f\u660e\u5ea6\u3001\u554f\u8cac\u53ca\u958b\u653e\u6cbb\u7406\u7684\u5ee3\u6cdb\u5012\u9000\u3002\u7576\u5c40\u5fc5\u9808\u9032\u884c\u6cd5\u5f8b\u6539\u9769\uff0c\u589e\u5f37\u884c\u653f\u8207\u7acb\u6cd5\u900f\u660e\u5ea6\uff1b\u5546\u696d\u754c\u8207\u570b\u969b\u793e\u6703\u4ea6\u61c9\u5171\u540c\u52aa\u529b\u7dad\u8b77\u9999\u6e2f\u8cc7\u8a0a\u81ea\u7531\u53ca\u8a00\u8ad6\u81ea\u7531\uff0c\u4ee5\u6062\u5fa9\u4e26\u4fdd\u969c\u9999\u6e2f\u7684\u9577\u671f\u7a69\u5b9a\u3001\u7d93\u6fdf\u7af6\u722d\u529b\u53ca\u5168\u7403\u5730\u4f4d\uff1b\u95dc\u6ce8\u9999\u6e2f\u7684\u6301\u4efd\u8005\u52d9\u9808\u589e\u5f37\u516c\u6c11\u793e\u6703\u53c3\u8207\u53ca\u52a0\u5f37\u570b\u969b\u554f\u8cac\uff0c\u4ee5\u6062\u5fa9\u9999\u6e2f\u8cc7\u8a0a\u81ea\u7531\u548c\u5176\u570b\u969b\u91d1\u878d\u53ca\u8cc7\u8a0a\u6a1e\u7d10\u7684\u8072\u8b7d\u3002<\/p>\n\n\n\n<p><strong>\u672c\u5831\u544a\u7684\u4e3b\u8981\u8ad6\u9ede\u548c\u8ad6\u64da\u5982\u4e0b\uff1a<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>\u6cd5\u5f8b\u53ca\u5236\u5ea6\u969c\u7919\uff1a\u9999\u6e2f\u7f3a\u4e4f\u6a94\u6848\u6cd5\u53ca\u8cc7\u8a0a\u81ea\u7531\u6cd5\uff0c\u5c0e\u81f4\u653f\u5e9c\u4e0d\u900f\u660e\u53ca\u4efb\u610f\u92b7\u6bc0\u7d00\u9304\u3002<\/li>\n\n\n\n<li>\u65b0\u805e\u81ea\u7531\u53d7\u4fb5\u8755\uff1a\u8a18\u8005\u9762\u81e8\u5be9\u67e5\u3001\u7c3d\u8b49\u88ab\u62d2\u3001\u9a37\u64fe\u53ca\u902e\u6355\uff0c\u5c0e\u81f4\u81ea\u6211\u5be9\u67e5\u53ca\u5a92\u9ad4\u64a4\u51fa\u9999\u6e2f\u3002<\/li>\n\n\n\n<li>\u570b\u5bb6\u5c0d\u8cc7\u8a0a\u4f9b\u61c9\u93c8\u7684\u63a7\u5236\uff1a\u653f\u5e9c\u589e\u52a0\u6578\u64da\u79fb\u9664\u3001\u62d2\u7d55\u8cc7\u8a0a\u8981\u6c42\uff0c\u4e26\u900f\u904e\u6cd5\u9662\u7981\u5236\u4ee4\u58d3\u5236\u91cd\u8981\u8cc7\u8a0a\u7684\u5b58\u53d6\u3002<\/li>\n\n\n\n<li>\u5b58\u53d6\u53ca\u50b3\u64ad\u8cc7\u8a0a\u7684\u6cd5\u5f8b\u5f8c\u679c\uff1a\u300a\u7dad\u8b77\u570b\u5bb6\u5b89\u5168\u689d\u4f8b\u300b\u5c0d\u300c\u570b\u5bb6\u6a5f\u5bc6\u300d\u53ca\u300c\u9593\u8adc\u6d3b\u52d5\u300d\u7684\u6a21\u7cca\u5b9a\u7fa9\uff0c\u4f7f\u7814\u7a76\u4eba\u54e1\u3001\u5546\u754c\u53ca\u8a18\u8005\u9762\u81e8\u6f5b\u5728\u8d77\u8a34\u3002<\/li>\n\n\n\n<li>\u570b\u969b\u5546\u696d\u53ca\u6295\u8cc7\u98a8\u96aa\uff1a\u91d1\u878d\u6578\u64da\u900f\u660e\u5ea6\u7684\u9650\u5236\u53ca\u5b89\u5168\u6cd5\u4f8b\u7684\u57df\u5916\u61c9\u7528\u5a01\u8105\u9999\u6e2f\u4f5c\u70ba\u570b\u969b\u5546\u696d\u4e2d\u5fc3\u7684\u5438\u5f15\u529b\u3002<\/li>\n<\/ol>\n\n\n\n<p><strong>\u88dc\u6551\u63aa\u65bd\uff1a<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>\u6cd5\u5f8b\u5236\u5ea6\uff1a\u5236\u8a02\u7b26\u5408\u570b\u969b\u6a19\u6e96\u7684\u6a94\u6848\u6cd5\u53ca\u8cc7\u8a0a\u81ea\u7531\u6cd5\uff1b\u7d42\u5be9\u6cd5\u9662\u64a4\u92b7\uff08\u63a8\u7ffb\uff1f\uff09\u9650\u5236\u8cc7\u8a0a\u81ea\u7531\u7684\u6cd5\u5ead\u88c1\u6c7a\u3002<\/li>\n\n\n\n<li>\u884c\u653f\u7576\u5c40\uff1a\u505c\u6b62\u5be9\u67e5\u653f\u7b56\u53ca\u79fb\u9664\u516c\u5171\u8cc7\u8a0a\uff1b\u57f7\u884c\u806f\u5408\u570b\u5efa\u8b70\uff0c\u4fee\u6539\u6216\u5ee2\u9664\u9055\u53cd\u570b\u969b\u4eba\u6b0a\u7fa9\u52d9\u7684\u570b\u5bb6\u5b89\u5168\u6cd5\u4f8b\u3002<\/li>\n\n\n\n<li>\u5546\u754c\u3001\u5546\u6703\u53ca\u6295\u8cc7\u8005\uff1a\u5021\u8b70\u6e05\u6670\u5b9a\u7fa9\u570b\u5bb6\u6a5f\u5bc6\uff1b\u5f37\u5316\u4f01\u696d\u653f\u7b56\uff0c\u62b5\u5236\u653f\u5e9c\u904e\u5ea6\u7684\u6578\u64da\u8981\u6c42\uff1b\u5b9a\u671f\u767c\u5e03\u6709\u95dc\u653f\u5e9c\u8cc7\u8a0a\u8981\u6c42\u7684\u300c\u900f\u660e\u5ea6\u5831\u544a\u300d\u3002<\/li>\n\n\n\n<li>\u516c\u6c11\u793e\u6703\uff1a\u52a0\u5f37\u5c0d\u9999\u6e2f\u8a18\u8005\u53ca\u7814\u7a76\u4eba\u54e1\u7684\u652f\u63f4\u7db2\u7d61\uff1b\u63a1\u7528\u6297\u5be9\u67e5\u6280\u8853\u4fdd\u969c\u516c\u5171\u6578\u64da\u53ca\u6578\u4f4d\u6a94\u6848\u3002<\/li>\n\n\n\n<li>\u570b\u969b\u7d44\u7e54\uff1a\u806f\u5408\u570b\u61c9\u76e3\u5bdf\u53ca\u5831\u544a\u9999\u6e2f\u8cc7\u8a0a\u81ea\u7531\u60c5\u6cc1\uff1b\u52a0\u5f37\u5c0d\u4e2d\u570b\u53ca\u9999\u6e2f\u7684\u5916\u4ea4\u58d3\u529b\uff0c\u4fdd\u969c\u8cc7\u8a0a\u5b8c\u6574\u6027\u8207\u4eba\u6b0a\u3002<\/li>\n<\/ol>\n\n\n\n<p>\u5831\u544a\u5168\u6587\uff08\u4e2d\u6587\u7248\uff09\uff1a\u6309\u6b64<a
